1. Collection of personal data
For the fulfilment of the contract
Personal data, as defined in this privacy policy, refers to specific details regarding your personal or factual circumstances; in other words, any information relating to an identified or identifiable natural person. This includes, in particular, the following in the context of initiating and processing business transactions: your surname and first name, your postal address and place of residence, your landline and mobile numbers, your email address, and further details such as the telephone number and address of your company or organisation, etc. When applying for a cancellable customer account, additional information regarding your bank details will be collected.

The personal data you provide to us during the ordering process is necessary for the conclusion of a contract with us. You are not obliged to provide your personal data. However, without your address, we cannot send you the goods. For some payment methods, we require the necessary payment details in order to pass them on to a payment service provider commissioned by us. The processing of the data you enter during the ordering process is therefore carried out for the purpose of fulfilling the contract.
If you send us an enquiry by email, via a contact form, etc. prior to the conclusion of a contract, we process the data received in this way to carry out pre-contractual measures and, for example, to answer your questions about our products. The legal basis for this processing is Article 6(1)(b) of the GDPR.
PaWorks GmbH collects, processes, stores and passes on personal data only to the extent that this is strictly necessary to fulfil an order and to provide the contractual partner with the requested information and services. Recipients may include: payment service providers, delivery service providers, hosting providers, where applicable, merchandise management systems, and where applicable, suppliers (dropshipping).

Personal data also includes information about your use of our website. In this context, we collect personal data from you as follows: information about your visits to our website, such as the volume of data transferred, the location from which you access data on our website, and other connection data and sources that you access. This is usually done through the use of log files and cookies. Further information on log files and cookies is provided below.
Comments

You have the option to post a comment. Your data (e.g. name/username, email address, website) will then be processed solely for the purpose of publishing your comment.
The legal basis for this processing is Article 6(1)(f) of the GDPR. Our legitimate interest is the public exchange of user opinions on specific topics and products. Publication serves, amongst other things, to promote transparency and the formation of opinions. Your interest in data protection is safeguarded, as you can post your comment under a pseudonym.
No specific retention period is envisaged. You may request the deletion of your comment at any time.

2. Purpose of use
PaWorks GmbH uses your personal data exclusively for the following purposes:
- Trade in specific products relating to ‘humans and animals’
- Operating physical retail outlets and an online shop
- Including all advisory and other services related to the aforementioned activities
- Services and consultancy for affiliated companies
- Services and consultancy for franchisees
- Sending out newsletters on request
- Information by post, email or telephone regarding potential new products, services, etc.; that is, for our own marketing purposes.
- Processing of incoming job applications as part of general human resources management
- General processing as part of human resources management
A data erasure policy for the various categories of personal data has been developed in accordance with statutory requirements and implemented accordingly.

3. Disclosure of your personal data
PaWorks GmbH will only disclose personal data to the extent strictly necessary to fulfil an order and to be able to provide the contractual partner with the requested information and services.
In some cases, we use service modules that make data available to the respective customer on our behalf. The service module providers (Net Inventors GmbH, Mario Maeles, Wrike) are independent companies and are, amongst other things, obliged by us to treat all data as strictly confidential; they are also prohibited from processing the data for any purposes other than those agreed. Each user can only view their own data or information relating to their own order history via a state-of-the-art login system.
Furthermore, our company does not pass on your personal data to third parties unless you have expressly consented to such data transfer or we are obliged to do so on the basis of legal provisions and/or official orders. Nor do we sell your data to third parties, nor do we market it in any other way.

Credit checks are usually carried out via PayPal.

5. Your rights
In addition to the right to withdraw the consent you have given to us, you are entitled to the following further rights, provided the relevant legal requirements are met:
a) The right to access your personal data held by us in accordance with Article 15 of the GDPR; in particular, you may request information regarding the purposes of processing, the categories of personal data, the categories of recipients to whom your data has been or will be disclosed, the intended period of storage, and the source of your data, provided that it was not collected directly from you,
b) The right to have inaccurate data rectified or accurate data completed in accordance with Article 16 of the GDPR,
c) the right to erasure of your data stored by us in accordance with Article 17 of the GDPR, provided that there are no statutory or contractual retention periods or other legal obligations or rights requiring further storage, 

d) the right to restriction of processing of your data in accordance with Article 18 of the GDPR
e) the right to data portability in accordance with Article 20 of the GDPR, i.e. the right to receive data you have provided in a commonly used, machine-readable format, or to request that it be transferred to another controller
f) Right to lodge a complaint with a supervisory authority. As a rule, you may contact the supervisory authority for your usual place of residence or for our company’s registered office.

6. Right to object
You may withdraw your consent to the storage of your data at any time. To do so, please use our direct email address info@dogstyler.de or write us a brief message and send it by post.

Upon receipt of your objection or withdrawal, PaWorks GmbH will no longer use your contractual partner’s data for its own marketing purposes and will cease sending promotional material. Please note that the complete deletion of customer data (following the completion of an order or contract) is only possible once the statutory retention periods under tax and commercial law have expired. The blocking of data for the purposes of customer service remains unaffected by this.

7. Right to lodge a complaint with the supervisory authority
You have the right to lodge a complaint with the data protection authority (see point 5). To do so, you may contact the authority responsible for your place of residence or federal state. 9. Means of communication
We protect our website and other systems against the loss, destruction, unauthorised access, alteration or disclosure of your data by unauthorised persons through technical and organisational measures. In particular, your personal data is transmitted to us in encrypted form. We use the SSL (Secure Socket Layer) encryption system for this purpose.

The use of communication channels, such as messaging services, must be considered in the overall context of data protection principles until the data protection authorities have reached a final decision regarding their scope and use, and will be adjusted in due course. In light of recent developments, we would like to take this opportunity to address the increasingly widespread use of WhatsApp in particular:

Privacy Policy regarding the use of WhatsApp
The Terms of Service and Privacy Policy of WhatsApp (Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA) apply. The exchange of information with PaWorks GmbH via WhatsApp is intended solely for general, non-legal information purposes and does not in any way replace a face-to-face consultation. Enquiries relating to personal data or accounts cannot be answered via this channel.

No legally binding declarations are made via this medium, nor can they be accepted by PaWorks GmbH. Please understand that, for security reasons, we are therefore unable to accept any legally binding orders or declarations via this communication channel.

We would like to draw your attention to the fact that data is stored on servers belonging to WhatsApp Inc., which are not subject to European data protection law; in other words, the processing of personal data takes place in countries outside the scope of Directive 95/46/EC. Confidentiality and data security may not be guaranteed on WhatsApp. PaWorks GmbH accepts no liability for any damage arising from the use of this platform. By installing and using WhatsApp on your mobile device, you agree to WhatsApp’s terms and conditions, over which PaWorks GmbH has no control. These stipulate, in particular, that you grant WhatsApp Inc. access to your telephone number and the contacts stored on your mobile device.
10. Duration of data retention
We will store your data for as long as is necessary to provide the agreed service.
- We store the data required for contract fulfilment until the expiry of the statutory warranty periods and, where applicable, contractual guarantee periods.
- We retain the data required under commercial and tax law for the periods specified by law, typically ten years (see Section 257 of the German Commercial Code (HGB) and Section 147 of the German Fiscal Code (AO)).
- Data processed for the purpose of carrying out pre-contractual measures will be deleted as soon as the measures have been carried out and it is clear that a contract will not be concluded.
Upon request, we can provide you with a certificate confirming this deletion.
A data erasure policy for the various categories of personal data has been developed on the basis of the statutory provisions and implemented accordingly.

11. Liability for content

The content of our website has been compiled with the utmost care. However, we cannot guarantee the accuracy, completeness or timeliness of the content. As a service provider, we are responsible for our own content on this website in accordance with Section 7(1) of the German Telemedia Act (TMG) and general legislation. When you access our website, connection data is stored. This means that, by default, whenever a file is accessed or an attempt is made to access a file on this server, the following data relating to this operation is stored in a log file (server log file) for the purposes of system security and for statistical purposes:

None of this data is directly personally identifiable. Personal data such as your name, address, telephone number or email address is not collected.
Based on this, this website uses the ‘Webalizer’ tool, a web analytics programme for the statistical analysis of user access to the site. ‘Webalizer’ uses data from the server log files to generate reports on, for example, the number of hits, file/page requests, visits, etc.
These analyses are not combined with other data sources, in particular with personal data. The information generated is stored by our provider in Germany. It is not passed on to third parties.

Session
Shopware uses the session cookie to determine whether the user in question has an active shopping basket and whether they are logged in. 16. Privacy Policy regarding the use of Hotjar
We use Hotjar software to improve the user experience on our websites. Hotjar enables us, amongst other things, to measure and analyse user behaviour (mouse movements, clicks, scroll depth, etc.) on our websites. This enables us to draw conclusions about the user experience when using our website. For this purpose, Hotjar places cookies on users’ devices and may store user data such as browser information, operating system, time spent on the site, IP address (in anonymised form), etc. A specific tracking code is also used for this purpose. 17. Privacy policy regarding the use of Facebook Pixel
The Visitor Action Pixel is a service provided by Facebook Inc., 1601 S. California Ave., Palo Alto, CA 94304, USA. It enables the tracking of users’ behaviour after they have clicked on a Facebook advert and been redirected to the website of the advertising or advertised company. Conversion tracking using the Visitor Action Pixel allows us to measure, analyse and optimise the effectiveness of Facebook adverts for statistical and market research purposes. The data collected on our websites via the Visitor Action Pixel does not enable us to identify individual users. The data collected (e.g. the user’s IP address) is transmitted to Facebook via the Visitor Action Pixel. This data is stored and processed by Facebook for the purpose of conversion tracking. Dogstyler receives reports from Facebook on conversion measurement in anonymised form. These reports also do not allow any conclusions to be drawn regarding the identity of users. However, it cannot be ruled out that Facebook may link the transmitted data with other personal data relating to the user (e.g. user data associated with an existing Facebook account) or that Facebook may use such data for its own further purposes.

The visitor action pixel is a service provided by a company (Facebook) independent of Dogstyler. We have no influence over the relevant data processing procedures in this regard. Facebook and its partners enable the display of advertisements on Facebook’s websites and on third-party sites. For the purposes of using the visitor action pixel and tracking related activities, a cookie may be stored on the user’s computer for these purposes.

Our website uses plugins from YouTube, a site operated by Google. The operator of the site is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit one of our pages featuring a YouTube plugin, a connection is established with YouTube’s servers. In doing so, the YouTube server is informed which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to link your browsing behaviour directly to your personal profile.
