General Terms and Conditions

§ 1 Scope, Customer Information
The following General Terms and Conditions (GTC) govern the contractual relationship between PaWorks GmbH (Dogstyler) and consumers and businesses who purchase goods via our shop. We do not recognise any terms and conditions that conflict with or deviate from our General Terms and Conditions. The contract language is German.

§ 2 Conclusion of Contract
(1) The offers on the website constitute a binding offer to you to purchase goods.

(2) You may add one or more products to your shopping basket. During the ordering process, you enter your details and preferences regarding payment method, delivery options, etc. You only accept this offer to conclude a contract of sale by clicking the ‘Order’ button. You may also conclude the contract of sale by fax.

§ 3 Customer information: Storage of the contract text
We will store your order along with the details of the contract concluded (e.g. type of product, price, etc.). We will send you the Terms and Conditions; however, you can also access them at any time via our website after the contract has been concluded. As a registered customer, you can access your previous orders via the customer login area (Your Account).

§ 4 Customer information: Correction notice
You can correct your entries at any time using the delete button before submitting your order. We will inform you of further correction options as you progress through the ordering process. You can also terminate the ordering process completely at any time by closing the browser window.

§ 5 Retention of title
The purchased item remains our property until full payment has been made.

§ 6 Statutory rights in respect of defects and limitation period
(1) Statutory rights in respect of defects
Statutory rights in respect of defects apply to our goods.

(2) Warranty for consumers in respect of second-hand goods
Your claims for defects in second-hand goods become time-barred one year after the goods have been handed over to you. Excluded from this provision are claims for damages, claims arising from defects which we have fraudulently concealed, and claims arising from any guarantee we may have given regarding the quality of the goods. The statutory limitation periods apply to these excluded claims. Where a guarantee period applies, the longer of the two periods shall apply in favour of the buyer.

(3) Warranty for business customers
Your warranty claims arising from defects in the goods purchased shall become time-barred one year after the transfer of risk. The following claims are excluded from this provision

- claims for damages
- arising from defects fraudulently concealed
- arising from any guarantee that may apply
- for recourse under Sections 445a and 478 of the German Civil Code (BGB)
- arising from defects in building materials and components which have been used in accordance with their normal intended use in a building and have caused its defectiveness.

The statutory limitation periods shall apply to these excluded claims. In the event of any guarantee period, the longer period shall apply in favour of the purchaser.

§ 7 Limitation of Liability
We exclude liability for breaches of duty arising from slight negligence, provided that these do not relate to essential contractual obligations, damage resulting from injury to life, limb or health, guarantees or claims under the Product Liability Act (ProdHaftG). The same applies to breaches of duty by our vicarious agents and our legal representatives. Essential contractual obligations include, in particular, the obligation to hand over the goods to you and to transfer ownership of them to you. Furthermore, we are obliged to supply the goods to you free from material defects and defects of title.

§ 8 Jurisdiction for commercial matters
The exclusive place of jurisdiction for all disputes arising from this contract is our registered office if you are a trader.

§ 9 Consumer information: Participation in a dispute resolution procedure
